The question of how TDRs fit together with private property rights was presented to the Supreme Court in Suitum v. Tahoe Regional Planning Agency, 520 U.S. 725 (1997). While deciding the case on ripeness grounds, the Court intimated that TDRs were a legitimate reformulation of a landowner's rights, rather than part of the compensation paid to an owner whose rights had been taken.
