    • The Victorian Sentencing Manual lists public opinion as a "legal" factor to be taken into account in sentencing, however, the word "non-legal" in the context of the present article denotes that this factor is not formally formulated in sentencing legislation. In certain stages of the criminal justice system such as parole hearings, public opinion can play a legitimate role, as the risk of re-offending remains a primary role in these hearings, see for example R v Leaver [1994] NSWCCA 60907; see generally Boyle, C. and M.
