Art. 1 of the Agreement provides that "an antidumping measure shall be applied only under the circumstances provided for in Article VI of GATT 1994 and pursuant to investigations initiated and conducted in accordance with the provisions of this Agreement. The following provisions govern the application of Article VI of GATT 1994 in so far as action is taken under antidumping legislation or regulation." This provision defines the legal relationship between Art. VI and the Agreement.

In Korea's view, the provision articulates a principle or an objective. The EC argued that the provision does impose on a Member a mandatory obligation.
