Nor did the SC take a decision when prior to the institution of the Libya/Malta proceedings, the dispute was brought to its attention in 1980/81. In this case, the good offices of the Secretary-General Kurt Waldheim were instrumental in persuading Libya and Malta to bring their dispute to the Court. A draft resolution submitted by Nicaragua on 4 April 1984 was not adopted by the SC following the negative vote of the United States, which triggered Nicaragua's decision to bring the case to the Court.
