Taff Vale Railway Company v. Amalgamated Society of Railway Servants [1901] A.C.426. The Law Lords determined that that a registered trade union could be sued in its registered name; an unregistered trade union could be made collectively liable for damages, and might be sued in the names of its officers, executive committee members and trustees; and that damages and costs could be recovered from the property of the Trade Union, whether or not it was held by trustees. Although Parliament had excluded the crime of conspiracy from trade disputes in 1875, the effect of this decision was to establish a civil liability for conspiracy -as a tort.

Pensions varied from seven shillings to 20 shillings (£0.35 to £1.00) per week, according to the position occupied, the wages received, and the length of service. They were paid to employees who were 60 years of age and had served the Company continuously for at least 25 years. Although other companies offered pensions, few were as generous, and hardly any were non-contributory. It proved very difficult to determine whether the company had gone back on its word, whether Lewis had promised more than he was authorised to offer, or whether the union leadership had heard what it wanted to hear rather than what was actually offered. Certainly, both the company and the arbitrator were adamant that they had not promised the complete dismissal of free labour. In retrospect, many local activists came to believe that Bell, in his anxiety to end a strike based on such shaky legal footings, had deliberately misled them about the promised terms.
