    • Regulators' hegemony over the process sometimes puts them in an awkward position. In bank insolvencies, for instance, the Federal Deposit Insurance Corporation (FDIC) acts both as a claimant, because it steps into the shoes of the bank's depositors, and as a quasi-judicial entity with extensive discretion to determine how each claim is treated.
