    • The legal foundation for the decision was Article 16 of the 1992 federal constitution, which declares all international conventions and agreements to be a part of domestic law, and Article 135 of the 1990 Serbian constitution, which grants Serbia the right to ignore decisions of the federal government that it regards as contrary to the national interest. Both articles are part of constitutions - still in effect at the time - adopted unilaterally by governments under Milošević's control. The unusual Article 135 was most likely motivated by the conflict at the time between Milošević's nationalist-authoritarian Serbian regime and the liberal federal government of the last prime minister, Ante Marković.     • The Latin term tu quoque (literally "you're another" or "you too") describes a rhetorical effort to deflect accusations by arguing that an accuser may also be guilty. As a defense under international humanitarian law, it amounts to a claim that "breaches of international humanitarian law, being committed by the enemy, justify similar breaches by a belligerent." The ICTY trial chamber rejects this sort of defense on the grounds that international humanitarian law "lays down absolute obligations, namely obligations that are unconditional or in other words not based on reciprocity," and, therefore, that the obligation to comply does not depend on the conduct of another party. More detail is provided in a survey by the Belgrade-based Center for the Study of Alternatives reported in Nezavisna svetlost in March 2001. The survey reported that 82 percent of respondents agreed that Milošević should be tried for "war crimes, corruption, electoral fraud, and abuse of power," but only 4 percent agreed that he should be tried only for war crimes. On the question of whether Milošević should be sent to The Hague (the survey was carried out before his arrest), 56 percent of respondents with higher education said "yes," as did 45 percent of those with the equivalent of a high school education or less. Sixteen percent of those with higher education, and 24 percent of those without, were opposed to sending Milošević to The Hague. The results are summarized in Nezavisna svetlost (March 24-31, 2001). An interesting finding, although there is no assurance whatsoever of a random sample, can be found in the informal poll on the Web site of the weekly magazine NIN (www.nin.co.yu). NIN has been asking visitors to vote "yes" or "no" on the question "Should Milošević have been delivered to The Hague tribunal?" since the week he was remanded, with the results generally hovering at 35-40 percent in favor and 60-65 percent opposed since June 2001. A check of the site after the beginning of Milošević's trial, however, indicated a change. On February 14, 2002, the continuous informal poll showed 45.5 percent voting "yes" and 54.5 percent voting "no." These results should probably be taken with some reservations, however, because a number of factors could easily influence this sort of survey.

    • The case in question is the famous freezer truck incident in which the bodies of victims of massacres in Kosovo were apparently removed from the scene and destroyed. A diver found a freezer truck containing forty corpses in the Danube River near Kladovo in 1999, and the case was quickly suppressed. Local media reported extensively on the case after the information was publicly revealed in April 2001. In May 2001, prosecutors declared that they had traced the effort to destroy evidence of massacres directly to Milošević.
