This directive stipulates: 'For the purposes of this Directive, the removal, collection and use of tissues, cells and substances of human origin shall be governed, in relation to ethics, by the principles laid down in the Convention of the Council of Europe for the protection of human rights and dignity of human beings with regard to the application of biology and medicine and by any Member States regulations on this matter' (art. 1.4).

Mention should be given to the Charter of Fundamental Rights of the European Union, approved by the European Council on 14 October 2000, which stipulates the prohibition of making the human body and its parts as such a source of financial gain, and the prohibition of the reproductive cloning of human beings (art. 3.2).

At the universal level, the UNESCO Universal Declaration on the Human Genome and the Human Rights of 11 November 1997 does not take a position about the possibility of experimenting with human embryos, although it clearly rejects reproductive human cloning (art. 11). It is a topic that could be pending for a future convention, also universal, about the same matter as the declaration.

In this paper I do not intend to deal with an important discussion: whether ES cells are or are not to be considered as a medicinal product or a medical device, and consequently to be regulated as these are. However my opinion is against this focus, as art. 18 of EC on Human Rights and Biomedicine is evidence for the need of a different approach. However, see a contrary position on the subject, P.
