3 Managed care is a system of health care management. There are a number of different forms of managed care systems. As a group, the systems are called integrated delivery systems. The health care industry is continuing to undergo epic consolidation and reorganization. The driving force of these extraordinary market changes has been to manage health care or "managed care." Managed care seeks to drive down the escalatory cost of care and increase access to care, while maintaining and improving the quality of care through the development of numerous types of health care delivery systems which incorporate a variety of cost efficiencies, all with the goal of an integrated comprehensive system. These health care systems combine the financing of services with the delivery of care into one enterprise. The application of managed care systems has not only driven the commercial market, but has crossed over to government regulated health care, resulting in Medicare risk contracting and Medicaid managed care through Federally Qualified Health Maintenance Organizations, health maintenance organizations ("HMOs") and other prepaid health plans. Because the concept of managed care is so broad, it is important to establish a base of understanding upon which an examination of the relevant regulations and attendant risks can be understood. Embodied within managed care are a variety of integrated health care delivery systems which attempt to be responsive to today's economic realities. An integrated delivery system ("IDS") is a vehicle in which an enumerated list of health care services are provided to enrollees while implementing cost and quality control mechanisms designed to create efficiencies. IDSs are formed for a variety of reasons: (1) to create a contracting force in the marketplace; (2) to increase market leverage and access for both the provider and IDS; (3) to maintain a level of autonomy and control where the IDS is provider owned; (4) to boost profit margins by controlling access and cost; and (5) to apportion or otherwise control risks associated with the delivery of health care. The overall purpose of any IDS is to provide high quality, medically necessary health care services in a cost efficient manner. This is the essence of managed care .... Examples of the more common IDSs are HMOs, Preferred Provider Organizations ("PPOs"), Exclusive Provider Organizations ("EPOs"), Point of Service Plans ("POS"), Physician Hospital Organizations ("PHOs"), Individual or Independent Practice Associations ("IPAs") and Management Organizations ("MSOs"). 155 Case 1: The Dukes case involved the wife of a man who was having trouble with his ears and received surgery. At that time, blood was drawn and was sent for testing. The medical center where the blood was sent for testing refused to test it. The next day, Mr. Dukes sought treatment from another physician, who again drew blood. This time it was tested. Nevertheless, Mr. Dukes' condition worsened and he died. His blood sugar was extremely high at the time of his death. Allegedly, if the testing had been done originally, then the condition could have been treated. Case 2: The Visconti case is brought by the parents of Serena Visconti who was stillborn. While in her third trimester, Mrs. Visconti developed symptoms of preeclampsia and her physician ignored her symptoms. As a result, the Viscontis claimed that the child was stillborn.
