The ECJ stated that the very nature of the Treaty of Rome applies to all economic sectors, be it goods or services. As such, maritime transport is subject to the general provisions of the Treaty of Rome. This means that Articles 48–51, relating to the free movement of persons, in particular workers, constitutes one of the pillars of the Community. Not complying with this provision means applying the principle of discrimination, which is not supported by the Treaty of Rome
