Only one state, Montana, had legislation on unjust termination during the sample period. However, because that state has a tradition of codifying in legislation the precedents set by its state courts, the 1987 passage of the act was a response to its courts having previously recognized exceptions. Krueger (1991) argues that employers will favor such laws if they limit damage recoveries, and employer support for a 1996 Arizona act that limited damages in public policy cases provides further evidence for his claim (BNA, 1996). While Montana was included in the estimation of results presented below, excluding it from the sample did not affect the results.
