The notion of "bottleneck" needs explanation. It may relate to objective scarcities in capacity. In this context, the "European Initiative in Electronic Commerce" (supra note 16) indicates (p. 9) "Removing capacity bottlenecks: Europe must take steps to ensure that a high bandwidth infrastructure is put in place in order to ensure that consumers and business take full benefit of ongoing technological developments which, inevitably, lead to ever increasing needs for more transmission capacity." On the other hand, there is a more subjective significance of "bottleneck facility" where, although objectively sufficient capacity exists, a service provider requires access to one or more (upstream or downstream) facilities in order to provide services to end users. E.g. to make the respective service physically available to end users, it needs access to the termination points of the telecommunications network to which these end users are connected. As well as physical access, a service provider may need access to other facilities to enable it to market its service to end users, e.g. the ability to create awareness of services. The concept of Access to bottleneck facilities started to be defined more explicitly as an "essential facilities concept" in the context of EU competition law.
