The court found that the Federal Cigarette Labeling and Advertising Act did not preempt Baltimore's ban on tobacco billboards. The court also held that the tobacco billboard ban, and a similar ban on alocohol billboards, do not violate the First Amendment to the US Constitution. In April, 1997, the US Supreme Court declined to review the decisions. Ibid
