    • While the clause generally applies to the private sector, if OSHA approves a state occupational safety and health plan, then it is also applicable to state and local government.

    • In the current political climate OSHA is not contemplating the expansion of the general duty clause to specifically cover violence. Its concern with the issue remains, however, as illustrated by the recent issuance of advisory guidelines for highly-vulnerable health service providers [U.S. Department of Labor (1996) Guidelines for Preventing Workplace Violence for Health Care and Social Service Workers (Washington, D.C.: The Department, OSHA, Publication no. 3148)]. • note
    • It might be noted that some states are considering action or issued executive orders (e.g., Oregon, North Carolina, New Jersey) and that individual agencies within states may have useful strategies (although they are rarely reported in the literature). The fact remains, however, that there are few statewide laws covering all agencies and their employees.

    • Not only that there has been little spread of preventive strategies across state governments, but also not as much as might be hoped for within the private sector. Tom Dunkel reports that just 20 percent of businesses have policies. See his "The Newest Danger Zone: Your Office," Working Woman 19 (August), pp. 38-41; 70-73.
